Joy Casey,

M.A., LL.B., Counsel

Joy divides her time almost equally between employment law and commercial litigation, the former in her role as counsel to Rubin Thomlinson LLP.

En route to studying law, Joy completed a masters degree and spent several years pursuing a doctorate of philosophy in Classics at the University of Toronto, as well as teaching Classics at the university level.

Her life-long quest for learning is apparent in the way she practices law. Joy’s focus is on litigation: preparing cases for court; and trying those cases that cannot be resolved. Joy acts for employers and employees in wrongful dismissal actions; counsels on severance arrangements and employment contracts; litigates Employment Standards issues; advises on labour relations matters; and deals with issues of disability, harassment and discrimination.

An area of employment law that intrigues her is dealing with employees who, upon departure from a company, unfairly compete with their previous employer or misuse the employer’s confidential, proprietary information.

Her track record in court is exemplary. She has won numerous cases before the Superior Court of Justice and the Court of Appeal, and many of her cases have been reported. In addition to wrongful dismissal claims, her cases have dealt with such issues as: increased damages due to disability issues, mental distress or bad faith conduct; wrongful dismissal in the context of oppressive conduct by majority shareholders against minority shareholder/employees; injunctions to prevent unfair competition or misappropriation of confidential information; and "civil search warrants" to seize and protect evidence prior to trial.

Joy takes a practical, results-oriented approach to resolving claims either through litigation or alternative dispute resolution.

She graduated from the Faculty of Law at the University of Toronto and was called to the Bar in 1986. She articled with a major national law firm and remained an associate in its Toronto litigation department until 1993. She is a member of the Law Society of Upper Canada, the Canadian Bar Association and the Advocates Society. She has taught Legal Writing and Professional Responsibility at the Bar Admission course.

Joy is a current executive member, and past chair, of the Ontario Bar Association’s Feminist Legal Analysis Section and past chair of OBA committees on Gender Issues, Legal Education and Submissions. She is actively involved in issues concerning equity, discrimination and the status of women in the legal profession. She is currently advocating the need for the legal profession to adopt clear language and address problems of functional illiteracy.
