HR Professionals

If you’re a human resources professional or manager within a small, mid-size or large organization, you may find yourself responsible for conducting workplace investigations into problematic employee behaviour. For many of our clients this is happening with greater frequency and complexity, as a result of one or more of the following issues:

  • An employee files a harassment or discrimination complaint
  • An employee is suspected of engaging in inappropriate workplace conduct
  • A department has become “poisoned” and is not functioning
  • A concern that a human rights application or complaint under occupational health and safety legislation will be filed, or a lawsuit initiated

Conducting a workplace investigation can be challenging in and of itself. There are enough complexities to fill a book (which we know only too well, as we’re the ones who wrote it). Add to this the courts’, tribunals’ and adjudicators’ heightened expectation that workplace investigations must be done right. Increasingly, there is less tolerance for errors, missteps or omissions. Any employers who take remedial or disciplinary action without knowing all the facts, or following all the steps, risk incurring the high costs associated with legal exposure.

Given the intense scrutiny and growing demands, it’s critical that anyone conducting a workplace investigation today have the essential knowledge and skill.
